Burkhard Hess教授为卢森堡马克斯·普朗克国际民事程序、欧洲民事程序和私人规制程序法研究所创始人和执行所长（2012年9月起任）。他毕业于维尔茨堡大学、洛桑大学和慕尼黑大学法学院，并于1996年获得了大学任教资格证书，之后，执教于慕尼黑大学、图宾根大学和海德堡大学，教授民法、民事诉讼法、国际私法、欧洲法和国际公法等。Hess教授曾任图宾根大学法学院院长和海德堡大学法学院院长，并曾任中国人民大学、法国巴黎一大和美国乔治城大学客座教授，美国纽约大学跨国法中心常驻学者和卡尔斯鲁厄上诉法院兼职法官。他经常作为欧盟委员会、欧洲议会、欧洲理事会和各国政府的法律专家顾问，为之提供有效意见和建议。Hess教授曾评估了《欧洲破产条例》和《布鲁塞尔一号条例》，协助起草了《欧洲银行账户扣押条例》提案。Hess教授出版了多本关于德国与欧洲民事诉讼法的书籍，他是国际法协会国际私法和程序法隐私保护委员会主席和国际诉讼法学会欧洲区副主席。2015年3月，比利时根特大学授予Hess教授荣誉博士学位；2016年5月，希腊塞萨洛尼基亚里士多德大学也授予了其荣誉博士学位。
Professor Burkhard Hess became founding and executive director of the Max Planck Institute Luxembourg for International, European and Regulatory Procedural Law in September 2012. He studied law at the Universities of Würzburg, Lausanne and Munich. After being granted Venia Legendi in civil law, civil procedure, private international law, European law and public international law in 1996, he held chairs at the Universities of Tübingen and Heidelberg. He was a guest professor of Renmin University, University of Paris I, University of Georgetown and a scholar-in-residence at the Center for Transnational Law at the New York University. He served as a part-time judge at the Court of Appeal of Karlsruhe. Professor Hess often acts as an expert and advisor to the European Commission, the European Parliament, the Council of Europe and national governments. He has evaluated the European Insolvency Regulation and the Brussels I Regulation. He has also contributed to the drafting of the proposal for the Regulation on the European Attachment of Bank Accounts. He is the author of various books on German and European civil procedural law. He is Chairman of the ILA Committee on the Protection of Privacy in Private International and Procedural Law and Vice-President Europe of the International Association of Procedural Law. In March 2015, the University of Ghent awarded Professor Hess a doctor honoris causa; in May 2016, the University of Thessaloniki.
讲座摘要：
国际诉讼法学会自2019年正式启动了的“比较程序法与司法”系列课题，该课题延续了15年前启动的“跨国民事诉讼原则”项目与10年前启动、今年正式完成的“欧洲民事诉讼示范规则”项目，体现了当代民事程序法与司法领域国际研究与合作的深化范式。因其公法属性，民事程序法常常被认为属于各国主权的固有范围。然而，国际学者深耕几十载，依托观察-比较-扬弃的功能主义比较法学方法，在承认差异的共识之下，力图通过对话形成超越国家立法者、重点关注“无知之幕”的更优做法，同时又充分考虑这种“最佳实践”最终融入不同立法与司法传统的现实可能性。“比较程序法与司法”系列课题是这一学术脉络的最新代表，关注理念、方法和民事诉讼的全过程与新问题；由其首席科学家Hess教授口述，更是了解比较民事诉讼法学渊源与前沿的“金钥匙”。
